TERMS AND CONDITIONS
At the Super Mountain Market (SMM), products are carefully selected, of high quality standards and we always make the effort to assist you according to your needs. To make your shopping experience as easy and smooth as possible we have put together a few points that apply to all online purchases:
Super Mountain Market is a temporary concept by Mario Weichselmann, Via Stredas 7, 7500 St. Moritz (hereinafter referred to as SMM) and sells goods to business / private customers (hereinafter referred to as "customer" (male and female form for simplicity reasons) offered both in our temporary concept space at Plaza Paracelsus 2, 7500 St. Moritz and in the online shop with the following conditions of sale and delivery (GTC).Prices for supplies and services in this contract are in Swiss Francs, below abbreviated as CHF.
The contract between the customer and SMM is not concluded until the order placed by the customer is accepted by SMM. The order is made on the internet and is binding. SMM accepts the order by providing the customer with an order confirmation via email.
3. Product Range
The information the customer receives during the ordering process concerning the goods is partially based on details provided directly by the supplier and is subject to change. SMM makes an effort to present and describe the goods as realistically as possible. A slight deviation in color through presentation on the monitor or a printout cannot be excluded. All product descriptions are only available in English. If you are uncertain about an English description, please contact us for descriptions in German, Italian, French or Romansh.
All published prices are indicative prices that are continuously adjusted to the market. These are in Swiss Francs (CHF), including VAT. For customers, the valid prices are always the ones published in the order confirmation sent by SMM.
5. Delivery Time and Stocks
SMM provides a personal delivery service for St. Moritz and the region (St. Moritz, Champfer, Sils-Maria, Silvaplana, Pontresina, Samedan, Bever, La Punt, Madulain, Zuoz, S-Chanf) starting from December 1st 2020. Online orders for products in stock received by 15:00 CET will be delivered between 18:00 – 20:00 CET on the same day. SMM is not offering a delivery service to other areas in Switzerland so far. In case of any delays, a written confirmation with the expected delivery time will be sent to the customer.
Should a product no longer be available no delivery will follow and SMM may withdraw from the contract. In this case the customer will be fully reimbursed.
The goods are delivered from St. Moritz. For all same day deliveries there is a minimum order of CHF 300. Orders under CHF 300 need to be picked-up from the Super Mountain Market at Plaza Paracelsus 2, 7500 St. Moritz once the pick-up is confirmed by the SMM
The specified delivery times are to be understood as a reference and cannot be guaranteed by us.
SMM accepts credit- and prepayments. Credit Card payments are handled through our payment provider Shopify. Payment is due at the order confirmation by SMM.
7. Return Policy
The customer has the right to withdraw from the contract within 5 working days without justification and to return the goods. Please return the items in an undamaged, functional, complete state and in undamaged, original packaging between 14:00 – 19:00 at the Super Mountain Market, 7500 St. Moritz. Please notify us at firstname.lastname@example.org so we can confirm your return. If no written return notice is given, an administrative fee of CHF 30.- will be charged. The right of return begins with receipt of the goods by the customer. The customer is responsible for the return and bears any risk and liability of return shipments. Returns need to be handled personally, we are not accepting returns via postal services.
Please contact us if you want to return the goods after the deadline so we can look for a suitable solution for you.
No right of return on clearance sales (sale), personal care products, sanitary products and perfumes.
8. Warranty for Defects and Liability
Products will be replaced or repaired free of charge if the defect is reported by the customer within 7 working days in writing after the receipt of goods. If a product is no longer repairable or replaceable, it will be replaced with an equivalent successor product, will be exchanged or a credit will be given. SMM is not liable for damages that are caused by incorrect use or natural wear and tear or for damage not caused to the delivery itself (consequential damages).
9. Intellectual Property
SMM reserves all rights for any design, text or graphics on their website. Copying or any other reproduction of the entire website or parts of it requires written permission (via email) by SMM. All other trademarks, product names, company names or logos quoted on this website are the property of their respective owner.
10. Data Protection
SMM ensures the adherence of the Swiss Data Protection Act and the relevant legal regulations whilst processing and using personal data. The accumulated customer data during the ordering process will only be used for internal market research purposes. A transfer to third parties occurs only for order processing and shipping and is absolutely necessary for proper service and delivery. The customer agrees to this use of his data.
11. Jurisdictions and Applicable Law
The present terms and contracts concluded under this GTC are subject to Swiss law, excluding the UN purchase right (CISG). Place of jurisdiction is St. Moritz.
12. Final Provisions
The conditions apply exclusively in the version valid at the time a purchase at the SMM online shop is made. These terms and conditions apply in particular if they should differ from those of the customer. SMM reserves the right to changes of these terms and conditions at any time.
At SMM we make it a priority to protect your privacy as a site visitor and customer.
We will not disclose information about you as a site visitor and customer to third parties except when necessary for shipping arrangements of your order, for payment transactions, to carry out security checks, when we have your consent to do so or when we are legally obliged under the laws of Switzerland.
We may also use information and statistics for the purposes of monitoring the usage of our website in order to help us develop and improve our services.
We cannot be held liable for the actions of any third party site from which you may have linked or been directed to the SMM website. Such sites have individual privacy policies which we advise you to study before providing any details.

You have the right to ask us not to process your personal information for marketing purposes.
